Terms and conditions for Reservation
Africa Adventure Safaris arranges tours/safaris in the whole of East Africa. You are advised to carefully read these terms and conditions for the sake of our contractual relationship with you. Circumstances render these terms and conditions amended from time to time. These terms are valid as they are at the time of booking and thus binding. Worth noting is the fact that Africa is a developing world where services offered are below in standard compared to Europe and North America. Thus in the provision of services we shall be subject to the laws of Uganda in which our company is registered.
Validity OF INFORMATION
All the content provided on this website has been provided in good faith based on well researched information at the time. We are not liable for Omissions or errors that may result from unexpected changes beyond our control.
From experience based on evaluations by our clients, we are proud of providing lodging / Hotel services as requested by our clients. For instance, if one applies for luxury accommodation there is no way we substitute it with mid-range accommodation. It is the image of our company that we cherish much more than high profits. Prices are determined on the basis of two persons sharing a double or a twin-bedded room. It is our right to substitute equivalent or better hotels.
Unless a specific accommodation is requested, we reserve or recommend the best or mid range facility, reasonably priced, charming hotels/lodges with private bath, hot water, and good service and value. Prices are based on two persons sharing a double or a twin-bedded room. We reserve the right to substitute equivalent or superior hotels. Shared accommodation for single travellers can be arranged on request. Single supplement applies only when the request is rejected.
CANCELLATIONS BY US
Rarely do we cancel confirmed bookings. It is only when the cancellation is unavoidable that we can resort to it. Our company cannot whatsoever cancel a confirmed safari / holiday less than 60 days before departure unless we are overtaken by unforeseeable circumstances beyond our control even with all due care. In the event of canceling your safari (as a result of force majeure) we shall allow you to obtain an alternative holiday with us of a similar standard to that formerly booked if it is available. If you choose a holiday cheaper than the former, the balance in this case will be refunded to you. And if it is more expensive you will automatically foot the difference. We are not liable for the loss, expense or costs as a result of a cancellation. You can be refunded your full amount of money except money for gorilla permits, which can only be refunded to you the company, can succeed to redeem it. We reserve the right to cancel a holiday of any person, if in our opinion the behavior of such a person is likely to cause anxiety, danger, annoyance, or insecurity to any third party. If such happens, such a person(s) will be required to immediately vacate or forfeit the services or accommodation being offered. Our company will not be held liable for any loss accruing in such circumstances.
CANCELLATIONS BY YOU
In case of a cancellation by you, you have to do it in writing. Such a cancellation is effective only when we have received a written notice from you. In order to make good the loss caused by your cancellation, cancellation fees will be levied on each person as below:-

Any cancellation received will lead to the forfeiture of a %age on the tour cost as follows:-
? 100 days and above 20%
? 60-100 days 30% of tour cost
? 46-59 days 50% of tour cost
? 16-45 days 80% of tour cost
? 0-15 days 100% of tour cost
NB. Cancellation fees are determined on the basis of the date your written notification is received at Africa Adenture Tours Ltd.
Complaints should be reported to the company office or our representative as soon as incident occurs and not later than 2 weeks after the end of your tour/safari/holiday so as to give us enough time to investigate the matter and respond appropriately. If the solution offered is unsatisfactory to you submit a written report to the tour manager in our Kampala Office so that an appropriate solution can be arranged for you. Ensure that follow our procedure in tendering in your complaint to avoid any regrets.
We regret we cannot compensate you where the performance of our obligations is hampered by unavoidable circumstances such as unanticipated government actions and laws, and natural disasters e.g. wars, extreme weather conditions, etc. Some services that we offer are purchased from other service providers e.g. hotel accommodation, restaurant services, transportation, medical evacuation services, etc. These are not within our control. So any damage, loss or death resulting from services acquired from independent suppliers beyond our control can not cause us any liability.
Optional activities such as walking tours Canoe, boat and white water rafting, Gorilla and Chimpanzee tracking, Mountaineering, Balloon safaris/tours carry with them inherent risk of personal injury. Should you choose them, your participation will be at your own risk.
We can only guarantee tracking gorillas only when weve purchased gorilla permits which is subject to your payment to us. Obtaining gorilla permits is not a guarantee for seeing a gorilla since local conditions sometimes determine their movements and availability at a particular time. We dont hold liability for any unforeseeable circumstances beyond our control that may result into your failure to track gorillas, e.g. abrupt closure of a National park/game reserve. A refund to you in this case will be subject to a refund by the wildlife Authority mandated to sell gorilla permits to our company.
Fortunately chances of seeing gorillas in Uganda and Rwanda are 98%.
You are advised to seek appropriate insurance before undertaking a safari/holiday. Such insurance policy should cover illness or death, cancellation of the holiday, loss or theft or damage to clients personal property, etc. Adventurous activities such as bungee jumping, mountaineering, white water rafting and animal tracking on foot should also be covered by such a policy. For clients undertaking a full holiday package we offer evacuation cover.
Africa Adenture Tours Ltd is registered in the Republic of Uganda and it falls under the jurisdiction and/ the laws of Uganda.
we bear liability for acts and/ omissions by our agents, employees, suppliers or / and sub-contractors if at the time of carrying their duties they had express permission from our company. If any part of your safari/holiday falls short of the agreed upon standards we shall make good the loss of the part thereof through compensation provided you follow the companys set procedure. Except in the event of death, personal injury, damage to personal possessions which are dealt with in the subsequent paragraph of these terms and conditions, our maximum liability in respect of complaints is limited to an amount equal to the cost paid by the client or his/her representative. A client will qualify for the maximum amount if he/she has obtained completely no benefit from the agreed upon service (holiday). Liability for loss of personal possessions such as personal luggage, including money, will be compensated to a maximum of US $50 provided the client undertook adequate insurance cover at the time of booking. However we shall take due care to avoid illness, death or damage of property of our client. Thus should any omission or mistake by our employees or agents cause you damage or death we shall be held liable.
Good physical and mental health is essential for the enjoyment of these active, outdoors tours. You may travel in rugged areas removed from modern medical facilities. Good physical conditioning is recommended as preparation for all tours, especially those involving trekking.
By forwarding the deposit, the passenger certifies that he/she does not have any physical or other condition of disability that would create a hazard for him/herself or other passengers. It is essential that any participant with a medical condition requiring regular treatment or which may be affected by vigorous activity, high altitude, heat, cold, other natural phenomenon, or particular foods, notifies us and the tour leaders, in writing in advance of travel.
We assume no liability for medical care nor for special dietary requirements if not informed long in advance. The medical requirements by some places like Ngamba Island is a sole responsibility of the client to meet them. We bring Ngamba Island and the client in direct contact so that he is furnished with what is required of him before walking with the chimps.
At the time of booking you must confirm acceptance of these terms and conditions and pay a deposit of 30% of the price of your holiday including fees for gorilla permits. If written acceptance is not received from you, we shall assume acceptance of the Terms and Conditions once you make the deposit. The balance must be paid in full before the start of the safari. It could be paid before coming or just before the start of the holiday. We however reserve the right to request full payment at least 30 days before start of the holiday.
PHOTOGRAPHY ON TOUR
We reserve the right to take photographic images of individual participants to use for commercial promotion of our safaris. Tour members who prefer that their image not be used are asked to identify themselves to their tour escort at the start of the tour.
Please ensure that the quotation given with details of number of clients, dates, accommodation, transportation, permits, park fees and all other services to be provided is clear and accurate before confirming the booking in writing. All references to quotations in writing shall include reference to correspondence by facsimile and electronic mail. The price of your chosen holiday will be confirmed at the time of booking. We reserve the right to correct errors in both advertised and confirmed prices and will do so as soon as we become aware of any such error. However, every care is taken to ensure that we provide right figures.
In case such situations arise, If you are required to pay more than 10% of the original holiday price, you will be entitled to cancel your holiday with the full refund of all the money paid to us except for fees paid for gorilla permits. Should you decide to cancel under these provisions, you must exercise your right to do so within 14 days of notification to you of the surcharge. We reserve the right to increase or decrease the prices of unsold holidays at any time.
Prices INCLUDE airport transfers; accommodation; meals as stated; the services of an English-speaking driver/guide and a 4×4 safari vehicle; portage of two items of baggage per person; boat trips; park fees; gorilla and chimpanzee permits where appropriate. Prices EXCLUDE all items of a personal nature such as entry visas, tips, telephone calls, laundry, gifts, airport taxes and all drinks. In Arusha, Kampala, Entebbe or Kigali the prices include bed and breakfast only. On safari the prices cover full board. The company reserves the right to vary the safari services agreed with the client in the event of unforeseen circumstances, such as road closures, bad weather, problems with national parks or hotels, security considerations. In such cases alternative arrangements will be made as circumstances permit.
We ensure that every person is entitled to a Window seat in the vehicle. Every effort is made to ensure that vehicles are provided in a roadworthy condition but no liability can be accepted for breakdown, or any damage or delay. Our guides are instructed to follow our code of conduct for Guides (available on request), which you must not ask them to break in any way. In the event that a Guide does not follow the code, please inform the Safari Manager in Kampala. Company vehicles must only be driven by the company’s Guide whose decision on all matters, such as the route taken, is final. You will be liable for any damage caused to a vehicle by any interference by you with the vehicle, including legal costs. Incase of breakdown, it’s our responsibility to rectify the situation. We can either withdraw the vehicle in question and replace it or if the breakdown is minor and can be rectifies, we reserve the right to do so.
My advancement of a deposit to Africa Adenture Tours Ltd certifies that I have carefully read and fully understood the contents of the Terms and Conditions, especially those regarding cancellation and refund policies, limitation of liability, and responsibility borne by trip participants. On the advance of a deposit to Africa Adenture Tours Limited., the depositor, his or her family and heirs agree to be bound by the above Terms and Conditions.
